TERMS AND CONDITIONS OF THE ONLINE STORE ADJSTD.COM
GENERAL PROVISIONS
These terms and conditions establish the rules for handling orders and purchases, specifically clothing, through the online store "adjstd.com." This includes the principles and procedures for concluding remote sales contracts, as well as the complaint procedure and the consumer's right of withdrawal.
The terms and conditions mentioned here comply with the Act on the Provision of Services by Electronic Means of July 18, 2002 (i.e. Journal of Laws of 2020, item 344, as amended).) and are in accordance with the Consumer Rights Act of May 30, 2014 (Journal of Laws from 2014, item 827) of July 18, 2002 (i.e., Journal of Laws of 2020, item 344, as amended)
These terms and conditions are addressed to all Customers of the Store. All Customers are required to familiarize themselves with the provisions of these terms and conditions before making a purchase. Each Customer is obliged to comply with these terms and conditions. Sales are conducted based on the version of the terms and conditions that is in effect at the time the order is placed. Every Customer can access the terms and conditions at any time by clicking the "Terms of Service" hyperlink on the Store's website. The terms and conditions can be downloaded and printed at any time.
Whenever the following terms are mentioned in these terms and conditions:
- Customer - a natural person, legal person, or organizational unit without legal personality, granted legal capacity by specific regulations, who places an order within the Store.
- Consumer - a Customer who is a natural person within the meaning of Article 22[1] of the Civil Code and Article 38a of the Consumer Rights Act.
- Civil Code - the Polish Civil Code Act of April 23, 1964, as amended.

- Online Store (also referred to as the Store) - the online service available at adjstd.com owned by the Seller, through which the Customer can place an order.
- Product - a movable item traded between the Store and the Customer.
- Transport Law - the Transport Law Act of November 15, 1984, Journal of Laws 1984 No. 53, item 272.
5. All Customers of the Store enter into a sales contract with the Seller. The contract is concluded in Polish or English, in accordance with Polish law and these terms and conditions. Before placing an order, Customers are informed by the Store about the unit price of the Product, the total price for the entire order, and the delivery costs. The final price to be paid includes the price of the product and delivery costs.
6. The Store reserves the right to introduce and cancel promotions on the Store's website, change Product prices, introduce new Products to the Store's offer, conduct and cancel promotional activities on the Store's website, and make changes to the applicable prices and terms and conditions. Any changes to the terms and conditions take effect upon their publication on the Store's website, which also constitutes their announcement. A Customer making purchases before the effective date of the changes is required to familiarize themselves with the new terms and conditions and then accept them. Failure to accept the terms and conditions will result in the resignation from purchases.
7. ADJSTD is the owner or licensee of all intellectual property on the website (e.g., copyrights to texts and graphic designs) and all materials posted on the website. They are protected by copyright law.
You may print one copy of the policy and download information from any page on the website for personal purposes, but not for commercial use without a license from us. You may not alter anything or use illustrations, video, and audio files, or photographs separately from the accompanying text.
If you violate these conditions, you lose the right to use our site and must destroy or return all copies made.
8. The Store informs that, according to the rules in force in the European Union, the Consumer has the right to withdraw from the sales contract within 14 days from the date of receiving the Product. The Store reserves the right not to reflect the actual stock status of Products in the Online Store. In case of a lack of Product in stock and the inability to fulfill the order, the Customer will be immediately informed of the situation.
By placing an order, the Customer agrees to the processing of their personal data in accordance with the Personal Data Protection Act of August 29, 1997 (Journal of Laws No. 133, item 833). The data provided by the Buyer is used solely for the purpose of processing and recording sales by the Seller. This data is not shared with third parties. The Customer may give separate consent to receive advertising materials and information about new products and promotions electronically. For this purpose, the Customer can add their email address to the Online Store's newsletter database. Adding an email address to the Online Store's newsletter database is entirely voluntary.
ORDERS
1. The Store conducts online sales through the website adjstd.com. Customers can place orders for Products available in the Store.
2. Orders can be placed 24 hours a day, 7 days a week. The Store accepts orders placed through the website adjstd.com.
3. The condition for accepting an order is to place it in accordance with the Store's rules and provide the necessary data to fulfill the order.
4. Orders can be placed after creating an account in the Store or without registration, by adding a product to the cart and placing an order directly.
5. To place an order, the Customer selects the desired Product, specifies the quantity, and clicks the "Add to Cart" button. Then the Customer clicks the "Proceed to Checkout" button, where they can log in to their account (if they have an account in the Store), create a new account, or place an order without registration.
6. If the Customer places an order without registration, they are required to provide contact details necessary for delivering the order.
7. After selecting the Products and providing all necessary data, the Customer clicks the "Confirm Purchase" button. If online payment is chosen, the Customer will be redirected to the external payment provider's page to complete the payment.
8. Orders placed through the Store's website are submitted in Polish or English. An order confirmation is automatically sent to the Customer's provided email address. The order confirmation contains all the necessary information regarding the order.
9. Information posted on the ADJSTD Store's website does not constitute an offer within the meaning of the Civil Code but an invitation to conclude a contract in accordance with Article 71 of the Civil Code. The Seller, i.e., the Online Store Karolina Kwiatkowska ADJSTD, undertakes to deliver all equipment components together with the purchased product to the Consumer. We ensure that the ordered goods will be delivered without physical defects, in accordance with applicable regulations.
PRICES AND PAYMENTS
1. The prices of Products listed on the Store's website are gross prices.
2. The prices listed in the store do not include delivery costs. The total cost of the order, including delivery costs, will be provided to the Buyer before the final order submission by clicking the "Place Order" button.
3. The Customer can choose one of the payment methods offered by the "Przelewy 24" payment service.
4. The Store reserves the right to introduce and cancel payment methods available in the Store, including suspending selected payment methods in certain cases.
DELIVERY AND PROCESSING TIMES
1. The order processing time is counted from the moment of obtaining positive payment authorization, or in the case of bank transfer, electronic payment, or card payment - from the day the funds are credited to the Seller's bank account.
2. The order will be fulfilled provided that the product is available in stock or at the Store's suppliers. If some of the goods covered by the order are unavailable, the Customer will be informed about the order status and decide on the method of its fulfillment (partial fulfillment, replacement with another product of the same value, extension of waiting time, cancellation of the entire order).
3. The default order processing time is 1-3 business days. In exceptional cases, the processing time may be extended to 10 business days, about which the Customer will be promptly informed. If the products are not in stock, the processing time will be agreed upon with the Customer individually, or the Customer may withdraw from the contract.
4. The Store reserves the right to extend the order processing time in the event of circumstances beyond the Store's control, such as technical difficulties, delays in the delivery of Products by the manufacturer or supplier.
5. Delivery of Products is carried out within European Union and under the conditions available on the Store's website. The Customer bears the delivery costs, which are indicated when placing the order.
6. The Customer has the right to choose the shipping provider from the available options during the order placement.
7. Detailed delivery conditions, including costs and delivery times, are indicated on the Store's website before placing an order and confirmed during the order placement process.
8. According to the provisions of the Civil Code, Article 548 § 1, the risk of accidental loss or damage to the sold item passes to the Consumer at the moment of its release by the carrier.
COMPLAINTS
1. Complaints do not cover Products that were damaged during improper maintenance, negligence, normal wear and tear, washing, as well as natural processes resulting from prolonged use.
2. Complaints can be submitted electronically to the email address: adjstd@icloud.com.
3. In case of non-conformity of the product with the contract, the consumer may file a complaint to the seller and request repair or replacement of the product.
4. The seller should respond to the complaint within 14 days from the date of its receipt. If the seller does not respond within this period, it is assumed that the complaint is accepted.
[If the Seller has refused to repair or replace the goods, has not repaired or replaced the goods, has attempted to repair or replace the goods but they are still not in conformity with the contract, has stated that they will not repair or replace the goods within a reasonable time or without excessive inconvenience to the consumer, the customer has the right to demand a price reduction or – in the case of significant non-compliance with the contract – to withdraw from the contract. If the lack of conformity with the contract is significant, the consumer may demand a price reduction or withdrawal from the contract without first exercising the right to demand repair or replacement.
The Seller shall carry out the repair or replacement within a reasonable time from the moment they were informed by the consumer about the lack of conformity with the contract and without excessive inconvenience to the consumer. The costs of repair or replacement are borne by the Seller. The choice between replacement and repair belongs to the consumer. However, if fulfilling the consumer's request is impossible or would require excessive costs for the seller, they may replace the goods instead of repairing them, or repair the goods instead of replacing them.
If both repair and replacement are impossible or would incur excessive costs, the seller may refuse to bring the goods into conformity with the contract. In assessing the excessive costs for the seller, all the circumstances of the case are taken into account, in particular the significance of the lack of conformity of the goods with the contract, the value of the goods in conformity with the contract, and the excessive inconvenience to the consumer resulting from the change in the method of bringing the goods into conformity with the contract.
The reduced price should be in proportion to the price arising from the contract, as the value of the goods not in conformity with the contract is to the value of the goods in conformity with the contract. The seller should refund the amounts due to the consumer as a result of exercising the right to reduce the price immediately, no later than within 14 days from the date of receiving the consumer's statement on the price reduction.]
4. The seller's liability for the non-conformity of the goods with the contract lasts for 2 years from the date of delivery of the goods.

RETURNS
1. A customer who has concluded a distance contract has the right to withdraw from it without giving any reason within 14 days.

ADJSTD
The package should include a correctly completed return form.
The return form is available in the order confirmation email or in the "RETURNS" section.
3. The seller may withhold the refund until receipt of the returned item or confirmation of its return (depending on which occurs first).
- The customer must prove that the purchased item originates from the online store adjstd.com. Besides standard documents such as a receipt or invoice, acceptable proof includes: bank transfer confirmation, return form, payment card or credit card statement, preserved correspondence such as emails.
5. Return packages sent to an incorrect address will not be collected.
6.The customer returns the products at their own risk and expense.
- In the case of withdrawal from the contract and return of goods, the costs of sending the item back to the seller are borne by the customer. The seller, however, refunds the buyer the equivalent of the product's price as wellas the delivery costs of the ordered goods – up to the amount corresponding to the cheapest delivery option available in the offer.
8. Returns and exchanges of goods purchased in the store are governed by applicable law, including in particular The Consumer Rights Act of May 30, 2014. -
Goods showing signs of use, missing original tags, aesthetic defects not reported at the time of purchase, or incomplete goods are not eligible for return or exchange.
10. The store refunds the purchase costs within 14 days from the date of receiving the consumer's declaration of withdrawal from the contract. The refund is made using the same payment method that the customer used.
11. The store reserves the right to refuse a return or exchange if the returned goods do not meet the conditions specified in the above points. - The seller does not provide a warranty on its products.

DATA PROTECTION
1, The store is the administrator of the personal data of customers. - Customers' personal data is processed in accordance with applicable law, including the Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons concerning the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation - GDPR).
3. Detailed information on the processing of customers' personal data is contained in the Privacy Policy available on the store's website.
CHANGES TO THE POLICIES
The store reserves the right to make changes to the policies for important reasons, such as:
- changes in the law,
- changes in the conditions of service provision by the store,
- changes in the scope of services provided,
- changes in the organization or way the store operates,
- the need to adapt the Regulations to the provisions of agreements concluded before the effective date of the changes,
- changes in prices and delivery costs, especially in the event of changes in the price lists of services provided by the delivery entity,
- other justified reasons justifying the introduction of changes.
2. Any changes to the Regulations will be communicated to customers by posting the new Regulations on the store's website along with information about the effective date of the changes. Customers who have an account in the store will also be informed about changes to the Regulations at the email address provided by them.
3. Changes to the Regulations take effect 14 days from the date of their publication on the store's website. Orders placed before the effective date of the changes to the Regulations are executed under the existing terms.
NEWSLETTER
1. The Regulations specify the conditions for providing electronic services by ADJSTD. - Before subscribing to the Newsletter, the user should read the Regulations and the Privacy Policy. The user confirms that they have read the Regulations and accept the provisions contained therein in their entirety and without reservations.
- Subscribing to the Newsletter is tantamount to accepting the Regulations and the Privacy Policy.
4. According to Art. 8 para. 3 of the Act on the Provision of Electronic Services, the Regulations specify in particular:
- types and scope of services provided electronically,
- conditions for providing electronic services,
- conditions for concluding and terminating contracts for the provision of electronic services,
- complaint procedure.
6. The user is required to confirm the subscription to the Newsletter service by clicking the confirmation link sent to the email address provided by the user.
7. The Newsletter service is provided free of charge for an indefinite period. Each party may opt-out of the service at any time by clicking the "Unsubscribe" button in the footer of the Newsletter email.
For matters not regulated in these regulations, the provisions of Polish law apply, in particular, the Civil Code, the Act on the Provision of Electronic Services, and the Consumer Rights Act.
In the event that the provisions applicable in the consumer's country are more favorable to the consumer and cannot be excluded by agreement, they will apply. This was confirmed by the CJEU judgment of 28 July 2016 in case C-191/15 in the proceedings Verein für Konsumenteninformation v. Amazon EU Sàrl.
